Toronto lawyers dedicated to helping people charged with impaired driving

It is often the wife, husband, or child of the accused who reports them to the police for impaired driving resulting in criminal DUI charges.

When an immediate family member reports someone for impaired driving it is often a situation where the accused has abused alcohol openly for quite some time. They may be fearful for the accused’s safety and the safety of others. For this reason they call the police to report it.

While most cases are likely reported out of concern for the family member and others, sometimes the family member is motivated to have the accused charged to gain an advantage in a family law, child custody/access, or CAS proceeding. Impaired driving is a crime regardless of these motivations of the person who calls it in and reports it but in some cases the facts may support the accused not being impaired while driving leading to the charges being dropped or an acquittal.

Sometimes a spouse/partner or child is angry with the accused and reports them being drunk without knowing whether they are or not.

They just want the police to get involved. The police will pull the person over and may charge for imparied driving (by alcohol or drugs) when in fact they are not impaired. The accused could be totally innocent yet end up charged in part because someone else said they were (for whatever reason whether goodhearted or vengeful).

While everyone is supposed to be considered innocent until proven guilty and the burden lies solely on the Crown to prove guilt beyond a reasonable doubt, the person accused of DUI still takes a tremendous loss even if the charges get dropped or they are found not guilty.

They will have spent a year or more worrying about the outcome, had to pay for a lawyer to defend them (we are not paid for by the Government like Doctors are), and still have their information retained in police databases that they were charged that can show up on background checks, when travelling including to the USA, for IRCC immigration Canada applications and more.
