Notice of Motor Vehicle Impoundment / Release
This document is often given by the police to those they charge with impaired driving offences. Sometimes the accused is offered at the roadside to have a friend or family member pick up the vehicle on their behalf to avoid this. The accused may have no friends or family to do this, or may feel embarrassed about being arrested for DUI and choose to have the car towed instead. In most Ontario cases the car will be towed particularly if the case is in the Greater Toronto Area. Rarely is the option to have someone else pick it up for them offered.For those who get charged with DUI on a 400-series highway such as the 401, 407, 409, 427, DVP, etc. they will likely be towed by the first tow truck that arrives on scene.
It is considered a public safety risk to have a parked vehicle on the side of the road which could result in an unnecessary collision if a third party driver must quickly pull off to the side.If the accused’s vehicle is towed and impounded after being charged with impaired driving they will have to pay for the towing and storage costs out of their own pocket. In impaired driving cases the impoundment time is normally 7 days. The costs associated with this can vary depending on the jurisdiction (county, city, town, etc.), but usually are over $500 at a minimum.
