Indian IT worker charged with DUI, impaired driving, over 80, or failure/refusal

We have a lot of clients who are immigrants from India who work in the IT industry and get charged with DUI related offences in Canada. Sometimes it is the spouse or partner of the accused who calls us for help. They are often afraid of losing their job.

Indian immigrants who get charged with DUI offences range from established Canadian Citizens who are concerned they will lose their job or go to jail to those in the IRCC/immigration system that are students, on work permits, or permanent residents (PR).

They have a lot to lose as a result of what is often a stupid mistake, peer pressure to drive drunk, or a miscalculation of how much alcoloh they consumed. In addition to potentially going to jail, being convicted of DUI in Canada carries at a minimum a sentence of a criminal record, having their immigration status revoked, deportation, and being denied entry into other countries such as the United States, the UK, Australia and New Zealand in the future.

Sometimes such charges can be dropped, withdrawn or reduced so that it does not have a negative impact on your immigration status, studies, job, or future travel abilities. There are many ways to contest such allegations such as applications under the Canadian Charter of Rights and Freedoms and opposing how the evidence was collected and analyzed by the police.
