Like any other criminal charge impaired driving usually starts with someone reporting it to the police. It is often a person the accused drunkenly felt that they trusted in advance who in reality can’t wait to pick up the phone, call 911, and report them. Sometimes it is family members, friends, or employees of dine-in restaurants, drive-thrus, etc. The accused often drank too much beer, wine or hard liquor while being served on a night out or with friends or showed up at a fast food joint drive-thru after having too much to drink. The people who smiled at them before they left were also probably smiling when they called the police.

People who drink and drive need to understand that 3rd parties, by nature, often like drama. They are not only going to call the police and report that you drove drunk they will also bask in their participation in your arrest. They want to do the right thing, and perhaps they did, but they should have stepped in before the person got behind the wheel if that was possible. It is obviously not always possible for them to do that.

People who get charged with drunk driving often call us the next day wondering why they were pulled over to begin with.

Everything seemed to be going fine. They were having a nice night out. No memorable incidents occurred. Why did the police target and arrest them? Usually it is because someone who saw them drinking or drunk before driving reported them.

When you are criminally charged with DUI your lawyer will eventually get the disclosure from the Crown Attorney and know exactly what the sequence of events leading up to and after the arrest was. While those accused of drunk driving may be factually guilty this does not make them legally guilty.
