Will I be defended by an actual criminal lawyer or a paralegal?

You will be represented only by a Practising Lawyer certified by the Law Society of Ontario, not a paralegal. It is important to note that paralegals are not licenced or legally permitted to represent those charged with impaired driving related offences.

How long will this process take?

Most cases take a few months to a year to resolve. This will largely depend on whether the accused pleads not guilty and fights the charged in court at trial or whether they decide to resolve their case (make a deal). In Ontario, sometimes an accused will be have the opportunity to regain the ability to drive (Stream A or B) and avoid a year long driving prohibition. The downside is that sometimes these deals can involve a guilty plea and a criminal record.

In some cases however the accused's lawyer may be able to have the criminal charged dropped and resolve the case with a provincial offence of careless driving or without any punishment at all depending on the evidence in the case. Depending on whether there is an agreement with the Crown Attorney to resolve the to have the charges dropped or not, there are normally at least 3 - 7 court appearances required.

For some types of court appearances, we are also able to attend court on your behalf (allowing you not to miss work).
