Penalties for imparied driving range up to 10 years and a very big factor is the harm, if any, that resulted from the accused being drunk behind the wheel. Ontario court judges are required to give a person found guilty of impaired driving a criminal record, fine and a one year driving prohibition at a minimum. If someone is hurt, killed, or property is damaged as a result of drinking and driving, the penalty even for a first time offender with no prior criminal record can easily include years in jail or a federal prison.
