The last thing anyone wants to happen is to injure or kill an innocent third party (other driver, pedestrian, biker, etc.) because they were drinking and driving. Penalties for imparied driving range up to 10 years and a very big factor is the harm, if any, that resulted from the accused being drunk behind the wheel. If there are innocent victims that are hurt (whether a willing passenger or unknown third party) the accused will likely face a much harsher sentence upon conviction.

Courts do not just consider the potential harm when evaluating and determining a sentence for a criminal offence, they also consider the harm placed upon the victim.

In impaired driving cases where nobody was hurt and no property was damaged, the victim is considered to be society as a whole. In cases where an accident has occurred, the sentencing judge will consider it to be a significant aggravating factor if someone was injured or killed, or if there is property damage. The accused will be looking at a much harsher sentence in these cases than if they were stopped without any direct injuries or property damage.

Ontario court judges are required to give a person found guilty of impaired driving a criminal record, fine and a one year driving prohibition at a minimum. If someone is hurt, killed, or property is damaged as a result of drinking and driving, the penalty even for a first time offender with no prior criminal record can easily include years in jail or a federal prison.
